Terms and Conditions
1. Scope and Applicability
These terms and conditions (the “T&Cs”) concern the use and/or provision of data (“Data”) from or to the PKRxiv. By creating an account, and using this platform you agree to be bound by and adhere to the applicable terms and conditions of this Agreement as may be amended from time to time by University of Liverpool at its sole discretion.
2. General PKRxiv Policy
Use of the Data is subject to the following General PKRxiv Policy:
- Licenced Use: The PKRxiv is licensed under the Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International. This license requires that reusers give credit to the creator. It allows reusers to copy and distribute the material in any medium or format in unadapted form and for noncommercial purposes only.
- Data Sharing Model: This platform operates a differentiated data sharing model, allowing users to apply one of three models to deposited datasets. By using this platform, you are confirming your agreement to be honest in declaring the use case for every dataset you may request, and to abide by the conditions associated with the datasets that you may be granted access to.
- Unrestricted use: All users could potentially be granted access to datasets shared under this model.
- Non-commercial use: Use cases with commercial interests will not be approved.
- Contributor-controlled: Decision regarding data release from PKRxiv and under what data sharing agreement is passed on to the data contributor.
- Requirement for Citation: To reference PKRxiv in any print or web publications, presentations, grant applications, or other documentation, please adhere to the following guidance:
- include a reference to one of the publications associated with the initial launch of PKRxiv and subsequent updates.
- where you have used data from PKRxiv in any work, full citations of the primary publications associated with the shared datasets will be provided. These must be cited as data sources.
- Data Reuse Publications: To help us document how PKRxiv content is being used and to facilitate further improvements of the platform, please send us the full citation of your work where PKRxiv data were used. This will be added to the ‘Publications from data reuse’ page.
3. Data Request T&Cs:
- Acknowledgement. You agree to appropriately acknowledge and provide attribution of the Data in accordance with the Citation guide in the PKRxiv Policy.
- Prohibited Uses. You will not attempt to de-anonymise the Data. The Data shall not be used for or in conjunction with the promotion of a commercial enterprise and/or its product(s) or service(s), and/or in any way that suggests that University of Liverpool endorses any specific company, products or services. Furthermore, you shall not use the Data in a manner that falsifies or misrepresents their content. These terms are in addition to the prohibited uses in the Licence.
- No Warranties by University of Liverpool. All reasonable precautions have been taken by University of Liverpool to verify the accuracy of the Data. Notwithstanding the foregoing, the Data are being provided to you without warranty of any kind, either expressed or implied. You will be solely responsible for your use of the Data. In no event shall University of Liverpool be liable for any damages arising from such use.
- Third-party Data. If you wish to use Data contributed under the Non-commercial or the Contributor-controlled Data Sharing Models, the risk of claims resulting from infringement on PKRxiv T&Cs or any third-party data sharing agreement signed between you and the data contributor rests solely with you.
- Modification/discontinuation of Data. University of Liverpool reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Data, any means of accessing or utilizing the Data with or without prior notice to you.
4. Data Contribution T&Cs:
- Acceptance of Data. You acknowledge that acceptance of the Data for inclusion in the PKRxiv is at the sole discretion of University of Liverpool. Furthermore, the University of Liverpool reserves the right at any time to temporarily, or permanently, remove the Data from the PKRxiv with or without notice to you.
- Warranty. You warrant and represent that all Data to be contributed to University of Liverpool hereunder is fully anonymised have been collected in accordance with applicable national laws, including data protection laws aimed at protecting the confidentiality of identifiable persons.
- Licence. You agree that, in respect of Data accepted for inclusion in the PKRxiv, University of Liverpool shall be entitled:
- to publish the Data and make the Data available to any interested party on request under the relevant terms and conditions of this Agreement; and
- to use, compile, aggregate, evaluate and analyse the Data and publish and disseminate the results thereof in conjunction with the University of Liverpool’s work and in accordance with the University of Liverpool’s policies and practices.
- Removal of Data. You acknowledge that if, once Data has been accepted into the PKRxiv, you have reasonable grounds to request removal of that Data, or any portion thereof, the University of Liverpool will make reasonable efforts to accommodate your request, but does not guarantee that it will be able to successfully recall Data already provided to any third party.
- Data correction. You agree to notify the University of Liverpool immediately in the event you discover a fault or error in the Data and in which case the University will remove the Data from the PKRxiv either permanently or until such time as the Data is corrected to the satisfaction of the University of Liverpool.
5. Other T&Cs Applicable to PKRxiv Users:
- Your Indemnification of University of Liverpool. You agree to indemnify University of Liverpool for, and hold University of Liverpool harmless against, any claims and liabilities, including reasonable legal fees and costs, arising from your use/provision of the Data and/or breach of this Agreement.
- No University of Liverpool endorsement. You shall not state or imply that University of Liverpool endorses the manner or purpose of your use or reproduction of the Data, or that University of Liverpool endorses any entity, organization, company, product or services.
- No use of University of Liverpool name and logo. Without the prior written approval of University of Liverpool, you will not use the name (or any abbreviation thereof) and/or logo of the University of Liverpool.
- Termination. University of Liverpool shall have the right to terminate this Agreement at any time by written notice to you, without incurring any liability whatsoever to you or others. Furthermore, this Agreement shall terminate automatically upon any breach by you of the terms of this Agreement. Upon receipt of a written request from University of Liverpool to that effect, you will (if in receipt of Data) promptly cease all use of, and destroy any and all copies of, the Data, and will confirm to University of Liverpool in writing that you have complied with the foregoing, no later than seven (7) days after receipt of University of Liverpool’s notification.
- Entire Agreement. This Agreement constitutes the entire agreement between you and University of Liverpool with respect to its subject matter. University of Liverpool is not bound by any additional terms that may appear in any communication from you. Any amendment to the terms and conditions of this Agreement shall be subject to University of Liverpool’s written agreement, it being agreed that University of Liverpool may amend the terms and conditions of this Agreement from time to time at its sole discretion.
- Headings. Paragraph headings in this Agreement are for reference only.
- Applicable law. This Agreement shall be construed and interpreted in accordance with the laws of England and Wales and is subject to the exclusive jurisdiction of the English courts.

The University of Liverpool is not responsible for any decisions or actions taken by users of the data nor as a result of information contained on or accessed through this website. In no event shall the University of Liverpool or their sponsors, partners or agents, be liable for any loss or damages of any kind arising from the use of, or inability to use, the data or from any content on our website or linked sites, including but not limited to, direct, indirect, incidental, consequential, and punitive damages.
